This matter was fixed for hearing on 22/07/2024 in the presence and with the consent of all parties. The Plaintiff had more than 5 (five) months to contact their clients and file any application to the court in the event of any inability or difficulty to proceed with today’s hearing. It is only on 2/12/2024 after 4.30pm that the advocates filed the application to cease acting for their clients.
Looking at the pleadings, this court takes note that the 1st to 7th Plaintiffs are company and/or legal entities that are duly registered in law with fixed office and addresses including Company Secretaries in compliance with the Companies Act. It is therefore a bit strange that the Plaintiffs cannot now trace their clients. To this end, the application for an adjournment is denied and the Plaintiffs’ application dated 2/12/2024 will be heard today at 2pm. The Plaintiffs’ advocates should serve their clients by mid-day today as well as the Defendants if any has not been served.
Both applications shall be heard at 2.30pm virtually and further orders issued.
