1. The accused was charged with the offence of murder contrary to Section 202 as read with Section 205 of the Penal Code Cap 63 Laws of Kenya. The particulars of the offence are that on the 26th day of December 2021 at Ujamaa area in Likoni Sub Location within Mombasa County murdered HAMISI HAMADI.
2. She was convicted. The court called for both the pre-sentence report shows that the offender met the deceased atleast four months before the incident. They were lovers but she decided to end the relationship when she realized the deceased(victim) was abusive, was keeping bad company and was depended on drugs. The deceased did not however agree to the separation and on the said date he came to the offender house and demanded sex, they argued as usual resulting to violence that led to the death of the victim and the offender is assessed to be at low risk in chances of reoffending she is remorseful and relates well within the community, she would therefore be supervised on non-custodial sactions and counselled on anger management.
3. As Mr. Mwawasi submitted the family of the deceased was at pains as they did not know the circumstances behind his death and the relationship he had with the accused.
4. Its noted that the deceased had a family but he went to force himself on the Accused person. Though that was not a licence to kill, the circumstances are regrettable.
5. Under the circumstances, the court will give the accused person a chance on rehabilation. She is placed on Probation for 3 years.
6. Right of Appeal explained.
