- The accused persons Lucas Nyandiga Ojenge, Ben Omondi Odeka, Joseph Ogilo Ojowi, Mary Scholastica Auma, Jane Anyango Nyandiga and Joseph Aluda Ojenge were jointly charged with the offence of murder contrary to Section 203 as read with Section 204 of the Penal Code in 5 counts.
- The particulars are that on the night of 28th day February 2019 at around 23.30 hours at Koluoch Village, Rongo Sub County within Migori County in the Republic of Kenya the accused persons jointly with others not before the court murdered Maritha Amolo Dwalo, Elida Akinyi Otieno, Levia Atieno Otieno, Brenda Akoth Otieno and Cynthia Adongo Otieno, This court has considered the evidence of the 8 prosecution witnesses which was recorded by Hon. Wendoh J and I do find that the prosecution has established a prima facie case sufficient to place all the accused persons on their defence for the murder of the deceased persons.
