'I have reviewed the evidence adduced by the prosecution. There is sufficient evidence that the Accused was seen assaulting the deceased prior to his demise. I hold that the prosecution has established a prima facie case that calls for an explanation by the Accused. I therefore place the Accused on his defence.'
