The accused persons are charged with offence of murder contrary to Section 203 as read with 204 of the Penal Code
The 2nd accused persons advocate objected to production of a confession statement allegedly taken by PW 9 Chief Inspector Phillip Ngatu
Upon consideration of the said objection this court hereby orders that a trial within trial be conducted to establish whether PW9 adhered to the Judges Rules when recording the said confession statement
This matter will be mentioned before Hon. Andayi J on 4.7.2024 for fixing a date for trial within trial
