The Republic VS FELIX KIPNGETICH KORIR

High Court at Kericho High Court · · Sergon

'
Felix Kipngetich Korir, the Accused Person herein underwent trial for the offence of Murder Contrary to Section 203 as read with Section 204 of the Penal Code.
The particulars of the offence are that on nights of 6 th and 7 th December, 2023 at an unknown time at Cherara Village Kaplelit Sub-Location within Kipkelion Sub-County in Kericho County murdered Brenda Chelangat.
The Prosecution presented the evidence of eight witnesses in support of its case against the Accused before closing its case.
At the close of the Prosecution’s Case, the Prosecution and the defence were invited to make submissions on whether a prima facie case has been made out for the Accused to be placed on his defence.
At the time of writing this ruling neither the defence nor the Prosecution had filed their submissions. I have carefully considered the evidence presented by the Prosecution and it is apparent that the Accused placed at the scene of crime. It is also apparent that there is circumstantial evidence linking the Accused to the offence.
In short, I am satisfied that the Prosecution has made out a prima facie case necessitating the Accused to be placed on his defence.
Consequently, the Accused is hereby placed on his defence. The Accused and his legal advisors should indicate whether he is going to personally testify in his defence. If yes, whether he would give sworn or unsworn testimony. The Accused should also indicate whether he would summon independent witnesses.
Dated, signed and delivered at Kericho this 30th day
of October, 2025.
