RULING ON SENTENCE
1. Emmanuel Matuya Ndiema has been convicted with murder. I have considered the presentence report, which is not favourable. I have also considered his mitigations and the sentence provided in law for murder. The accused said not to be a first offender He took the life of the deceased for no good reason.
2. Considering all the above I sentence Emmanuel Matuya Ndiema to serve (30) thirty years imprisonment. The period he has been in remand shall be taken into account as part of his sentence as provided under section 333(2) of the Criminal Procedure Code. Right of appeal explained .
