1. I have considered the mitigation and the fact that the accused is a first offender and aged 43 years, is remorseful, is the sole bread winner of his family and that he has been in custody for 4 years.
2. The court takes cognizance of the sentencing policy guidelines and the principles of sentencing espoused in Francis Karioko Muruatetu & another v Republic [2017]e KLR case.
3. I hereby exercise discretion and sentence the accused person to serve 25 years’ imprisonment, calculated from the date of arrest.
