I have considered the letter dated 24th July, 2026 authored by Hon. D. Mikoyan, Chief Magistrate, Kisumu Chief Magistrates' Court, vide which I have been requested to revise the sentence of the subject – Ian Duncan Ochieng – listed in Kisumu Criminal Case No. E271 of 2026 as the second accused.
Noting that the said subject is a minor, aged 14, and further considering the nature of the offence and the sentence imposed, I hereby revise, in line with Section 362 and 364 of the Criminal Procedure Code, and set aside sentence in in its entirety and substitute it with a discharge under Section 35(1) of the Penal Code.
The subject Ian Duncan Ochieng shall be set at liberty forthwith unless he is otherwise lawfully detained.
