This matter is coming up for review under decongestion exercise in the presence of parties. The court has called for and examined the trial record and perused the sentence review report dated 8 April 2026 from the probation office. The applicant was charged with the offence of stealing goods on transit and sentenced to two years imprisonment. He has served a period of more than 12 months and has a period of 3 months remaining at the time of this ruling.
Considering his age (62 years), the period remaining to be served in custody and the recommendation of the probation officer, it is hereby ordered:
1. That the Applicant has served a significant part of the sentence.
2. That the court guided by the sentencing policy guidelines hereby reviews the sentence to the time already spent in custody under the decongestion policy.
3. That the sentence be and is hereby reviewed to the time spent in custody and the applicant is hereby released forthwith.
4. That file is hereby closed.
