THE LAW SOCIETY OF KENYA AND KENYA HUMAN RIGHTS COMMISSION VS Kenya Aviation Workers Union AND KENYA AIRPORT AUTHORITY AND 5 Others

High Court at Milimani High Court · · Lucy Njuguna

The Honourable Court has considered the applicant's application dated 11 November 2024 filed under a certificate of urgency of even date. The court is not satisfied that the application is urgent. Bearing in mind the preliminary objection that has has been filed against the hearing of this suit, the question whether the applicants ought to have exhausted the dispute resolution mechanisms under the Public Private Partnerships Act cap. 430, before moving this Honourable Court for judicial review reliefs and, therefore, whether this suit is properly conceived, ought to be disposed of first before the court can consider the application for consolidation of this suit with any other suit. It follows that the applicant's application can only heard once the preliminary objection has been heard and determined. The applicant is, therefore, directed to serve the application to all the parties in the suit for such directions as may be necessary depending on the outcome of the preliminary objection. It is so ordered.
