RULING


The Application dated 20/03/2024 be and is hereby compromised in the following manner:-

  1. The Applicant who is the intended Appellant is granted leave of 14 days to prepare, file and serve the Memorandum of Appeal against the Judgment and decree pronounced on 30/01/2024 in the proceedings known as Kilgoris SPM ELC No. E004 of 2021.
  2. Pending the filing, hearing and determination of the intended Appeal against the Judgment and Decree pronounced on 30/01/2024, Judgment and Decree thereof shall be stayed until further orders.
  3. The Applicant/intended Appellant shall deposit a sum of Kshs.50,000/= while the Respondent will deposit a sum of Kshs.150,000/= into a joint interest earning account to be opened by the counsel for the Applicant and Respondent within 21 days from today’s date.
