1. I have perused the Notice of Motion dated 31st July 2025 vide which the applicants seek the stay of execution of the orders issued by this Court on 18th July 2025. On 18th July 2025, this Court granted the plaintiffs/applicants injunctive reliefs, among which are orders preventing the expulsion of the plaintiffs/respondents from the Mombasa Sports Club and the implementation of the resolutions reached during the impugned Annual General Meeting.
2. This is the second application filed after the delivery of the said ruling. Mr Michael O Sangoro filed the first application. That application was heard today. This Court reserved the matter for ruling on 22nd August 2025.
3. In my view, this application is not urgent nor is it expedient. Its hearing should abide the delivery of the pending ruling. The same should be served on all parties within three days of the date hereof for hearing interpartes on 22nd August 2025.
