1. I have considered the Notice of Motion dated 22nd March 2026 vide which stay of the execution of the judgment in ELRCMC E216 of 2023 Mombasa is sought. I note that the substratum of the appeal is an employment matter which was heard and determined by the Court below, and objection proceedings were filed once execution was attempted.
2. It is doubtful if the appeal was filed in the Court clothed with jurisdiction to hear and determine it. That being so I am unable to issue any interim orders. I direct that the application dated 22nd March 2026 be served within three weeks of the date hereof for hearing interpartes on 20th April 2026 before Visram, J.
