1. Before me is a Notice of Motion dated 9th March 2026 . The same is supported by the annexed affidavit of Mr Abdulhafeez Naushadali Noorani sworn on the same date. Vide the said application, the applicant, Swahili Beach Resorts Ltd , seeks the extension of time within which the Second Further Charge and the All Assets Debenture , both dated 28th January 2026 , by another 30 days .
2. The Second Further Charge is in respect of the Titles Nos. Kwale/Diani Beach Block/367 and 157 , which are owned by the Applicant. The All Assets Debenture is by the Applicant. The chargee in all the securities issued by the Applicant is the Diamond Trust Bank Kenya Ltd .
3. The Applicant contends that it was not able to register the said securities within the prescribed time, as the Land Registry took too long to process them following their submission for statutory stamping and registration. They further aver that unless the time within which registration can be done is extended the securities could become void.
4. I have considered the said application, the affidavit in support thereof and the annexures attached thereto. In my view, the same is merited, as the delay in the registration of the securities was caused by factors beyond their control. I order that the time within which the said securities may be registered be extended by another 30 days from 16th March 2026 .
5. It is so ordered.
Dated and signed at Mombasa this 14th day of March 2026 .
