RULING

  1. The hearing of this matter was fixed by consent on the 13.05.2025.
  2. This is a matter that has been in Court since the year 2014 and the same has never been prosecuted.
  3. Today, there is an intention to substitute the Plaintiff which action ought to have been done long ago if necessary.
  4. Consequently, it is clear the Plaintiff is not available to testify in this matter and therefore dismissed forthwith.
  5. The Defendants are granted costs of the suit.
  6. The file is closed.
