I have read the applicant's application dated 15 May 2026 filed under a certficate of urgency of even date. I am satisfed that the application is urgent. I direct that the application be served for mention for further directions before Wangari, J. on 27 May 2026. In the meantime;
1. Leave is hereby granted to the plaintiff to serve court process upon the defendants outside Kenya through the E-mail addresses used by the defendants’ agents to communicate with the plaintiff, namely info@dracodistributionltd.com and sales9830@outlook.com.
2. Subject to the plaintiff paying demurrage charges, port charges, customs charges, warehouse charges, and/or any other charges that may be due to Maersk Shipping Line, the Kenya Ports Authority, the Kenya Revenue Authority as well as the Uganda Revenue Authority, and upon the plaintiff executing any necessary indemnity, these entities, whether by themselves, their employees, servants, or agents, are hereby ordered to immediately release to the plaintiff the consignment of 28 Drum Steel of High Chrome Steel Grinding Media Balls Size 80 MM that was shipped through the port of Mombasa in container number SUDU 7535723 under bill of lading number 267125352 dated 13th March 2026 for repatriation to India or such other destination of the plaintiff’s choice other than Kenya.
3. Pending the hearing and determination of this suit, an order is hereby granted restraining Maersk Shipping Line, the Kenya Ports Authority, the Kenya Revenue Authority as well as the Uganda Revenue Authority, whether by themselves, their employees, servants, or agents from releasing to the defendants the consignment of 28 Drum Steel of High Chrome Steel Grinding Media Balls Size 80 MM that was shipped through the port of Mombasa in container number SUDU 7535723 under bill of lading number 267125352 dated 13th March 2026.
