By the ruling dated 19.04.2023 the court directed the Petitioner to show cause why the petition should be struck out as the subject dispute was the subject of arbitration. The Petitioner not having shown cause and the Respondent having informed the court that the arbitration proceedings are ongoing, the petition be and is hereby struck out. The Petitioner shall pay with costs to the Respondent assessed at Kshs. 25,000.00.
