The court has considered the application dated 8th April 2024 filed under a certificate of urgency. It is noted that the application seeks to stop the subdivision of the suit parcels of land which sub-division is being carried out in execution of a court judgement that is said to be dated 25th April 2002 in Kitui CMCC No. 144 of 2001. The court declines to certify the application as urgent and directs that it be served and heard inter partes on 23rd April 2024.
