STEPHEN MUTHOKA MALIA VS MOGO AUTO LIMITED

I have read the applicant's application dated 12 August 2026 filed under a certificate of urgency of even date. The application has been filed alongside a "petition". It is not clear to me why the applicant would file what appears to be a commercial dispute between him and the respondent as a petition. The nature or character of the "petition" itself is also not clear. In these circumstances, I am not satisfied that a competent application or suit is before the court upon which I can grant any of the prayers sought. I decline to certify the application as urgent and direct that it be served for directions in the new term on 29 September 2026.
