Ruling
1. Given that the subject matter herein is land and whereas this court has no subject matter jurisdiction to hear and determine land cases as the jurisdiction so to do is vested in the Environment and Land Court pursuant to the provisions of article 162 (2) (b) of the Constitution of Kenya 2010 and section 13 of the Environment and Land Court Act, I do hereby transfer this matter to the Environment and Land Court Bungoma for hearing and determination.
