1. I have perused the Notice of Motion dated 16th May 2025 vide which the applicant, the Honourable the Attorney General, seeks to have the respondent, Hellen Maria Imokor, declared a vexatious litigant and for her to be restrained from instituting any fresh legal proceedings or from continuing any proceedings she had previously instituted, without the leave of the court. The application is supported by the affidavit of Paul Waga, sworn on the 16th day of May 2025 and by the annexures attached thereto.
2. It would appear to me that the respondent was served with the said application on the 20th day of May 2025 at 7.40 am through her email address hellenmaria1988@yahoo.com. Subsequently, she was served with a hearing notice on 29th May and 21st July 2025 via WhatsApp through her number, 0769 864 518, and email, hellenmaria1988@yahoo.com.
3. Despite being served, the respondent is absent. I am satisfied that the respondent was given sufficient opportunity to be heard. As she is absent, the application is undefended and unopposed.
4. Under the Vexatious Proceedings Act, Cap 41 of the Laws of Kenya, the court may declare a person a vexatious litigant. I am satisfied, based on the evidence adduced, that the respondent is indeed a vexatious litigant and that the orders sought should issue.
5. I am also satisfied that the respondent meets the test for a vexatious litigant that was given in the case of Attorney General v Meshack Ochieng t/a Mecko Enterprises [2019] KEHC 7050 (KLR).
6. In the circumstances, I allow the applicant and declare that the respondent, Hellen Maria Imokor, is a vexatious litigant. I issue an order restraining Hellen Maria Imokor from instituting any new legal proceedings, or from continuing any proceedings already instituted without the leave of the court.
7. Due to the nature of the matter, I make no orders as to costs.
8. Orders accordingly.
Dated and signed in Mombasa this 22nd day of July 2025. Delivered virtually through Microsoft TEAMS.
