RULING
Having considered the application, I form the opinion that the application is not urgent for the following reasons; there is a similar and identical application dated 7/12/2022 which was ordered to be mentioned on 9/2/2023 by Mshilah J, the amount of the loan taken is not disclosed, the amount so far paid is not disclosed, the alleged statement of account supplied that allegedly has mistakes has not been produced, the allged illegality of the proposed auction has not been demonstrated, the mount due which is in excess of Kshs.150,000,000/- is neither challenged nor controverted.
Accordingly, let the application be served for further directions on 9/2/2023.
