RULING
1. The Applicant has filed an application seeking interim orders of an injunction. It is dated 21/4/2026.
2. The Appellant seeks to have two accounts that are stated, frozen pending the hearing of the application.
3. The Respondent represented by Counsel Mr. Wageche has disowned ownership or association with the accounts.
4. The Applicant indicates one of the accounts is in the name of Nexus Holdings Ltd. There is no other material placed before the Court to identify the owner of the Bank account.
5. The Court is hesitant to issue orders that may end up affecting a third party not named in these proceedings. For that reason, the interim orders sought are declined at that juncture. The Court would rather hear all the parties first.
6. On the other hand, the Applicant has established some urgency in the matter.
7. Let the Respondent file a response within the next 14 days.
8. The parties can thereafter file written submissions to the Preliminary Objection within 3 days each starting with the Respondent.
9. The matter be heard by way of highlighting of the Preliminary Objection dated 29.4.2026 on 26/5/2026. Parties to comply with the timelines strictly.
DATED, SIGNED AND DELIVERED AT MILIMANI THIS 30TH DAY OF APRIL, 2026.
