The Notice of Motion dated 06.02.2023 is made under section 36 of the Arbitration Act and it seeks recognition and enforcement an arbitral award. The application is not opposed and the time for setting aside the award has lapsed. The application is allowed on the following terms:
(a) The Final Award published by Carole Ayugi on 31st January 2022 is hereby recognized as a judgment of the court and leave is granted to the Applicant to execute it as decree of the court.
(b) The Applicant is awarded costs of the application assessed at Kshs. 50,000.00 only.
