SKYMAN FREIGHTERS LIMITED AND WANGAMATI ESTATES LIMITED AND 2 Others VS STANBIC BANK LIMITED AND PHILIPS INTERNATIONAL AUCTIONEERS

High Court at Mombasa High Court · · Jairus Ngaah

I have read the applicant's application dated 19 May 2025 filed under a certificate of urgency. From the applicant's own pleadings, I understand that there is a suit filed as a constitutional petition in which the applicant has obtained orders against the respondents which would in effect be similar to the orders sought in this application. I also hear the applicant to be saying that the respondents have, by threatening to auction the applicant's property, disobeyed the orders given in the constitutional petition. Against this background, I am not satisfied that the application is urgent. I direct that the same be served for mention for directions on the mode of its disposal on 4 June 2025. In the meantime, the respondents are directed to file and serve their response to the application within seven days of the date of service of the application. It is so ordered.
