I have considered the application by Kisumu Sugar Belt Union dated 30 April 2024 filed under a certificate of urgency of even date. I am satisfied that the application is urgent and it is so certified. Further I allow the motion to the extent that Kisumu Sugar Belt Union is joined to this suit as an interested party. I direct that the interested party files its response if any to the substantive application before court. The same to be filed and served within 7 days of the date hereof. The suit shall proceed for hearing as earlier scheduled on 20 May 2024.
