Simon VS Inspector General & another AND State Law Office AND 2 Others

High Court at Mombasa High Court · · Jairus Ngaah

I have read the applicant's motion dated 27 March 2025 filed under a certificate of urgency of even date. I gather from the applicant's pleadings and affidavit that although the applicant was held in custody for longer than the Constitution allows, he has finally been charged. Accordingly, there is no reason to certify the application as urgent. I direct that the application be served forthwith. The respondents have 14 days to file and serve their response to the application. The matter shall be mentioned after the Easter recess on 11 June 2025 for directions on the mode of its disposal. It is so ordered.
