SILVESTER MWILU MUTINDA VS The Republic

  1. The  applicant has  by  Notice of  Motion  dated  12th February 2025  sought  leave  to  file  appeal  out  of time.
  2. He states that he was charged in Makindu MCCRC No. E041 of 2022 with defilement and was sentenced to serve 20 years’ imprisonment on 19th June 2024.
  3. That he is dissatisfied with the judgment of the subordinate court and wishes to challenge it on appeal.
  4. I have   considered the application and the affidavit in support. The same is allowed. 
  5. The applicant  has leave to file and  serve  the   appeal  out of  time-   within  30  days  of  being supplied  with  the lower court record.
  6. Applicant and the Respondent be supplied with the proceedings and Judgment of the lower court
  7. Orders be served upon the applicant for compliance through the in charge High Court Registry
  8. Orders accordingly.
