'I have considered the application dated 29 August 2025 filed under a certificate of urgency of even date. According to the applicant, the amount agreed as outstanding as at 25 March 2024 was Kenya Shillings 13 million. However, it is not apparent from the pleadings or from the applicant''s own affidavit whether the applicant has been repaying or has repaid the agreed outstanding amount. I am not, therefore, satisfied that the application is urgent as to be heard during this Honourable Court''s current recess. I direct the application to be served for mention before Mutai, J on 24 September 2025 for directions on its disposal. In the meantime, the respondents are directed to file and serve their response to the application wthin seven days of the date of service of the applicant''s application. it is so ordered.'
