SHABAN KANDIA MAKAPIA VS RASHID OMENDE MAKAPIA AND AMAN OKANGA OSIEKO

I have considered Notice of Motion dated 5^th June 2024. There is no order of this Court compelling the Respondents to do anything or restraining them from doing anything. The Appellant’s complaint that the Respondents stopped him from ploughing the land cannot be said to be disobedience of any order of this Court.

I find no merit in Notice of Motion dated 5^th June 2024 and I dismiss it. No order on costs. The Subordinate Court’s file be forwarded to the Subordinate Court for further action.
