SEAMLESS PROPERTIES LIMITED AND NYALI SUNNY SIDE APARTMENTS LIMITED VS MIDDLE EAST BANK KENYA LIMITED AND REGENT AUCTIONEERS

High Court at Mombasa High Court · · Jairus Ngaah

'I have considered the applicant''s application under a certificate of urgency. The initial order directing that the matter was scheduled for 8 August 2025 was deleted and replaced with the order showing that the matter will be mentioned on 8 October 2025; this was after the error on the date was brought to the attention of the court. The order on record shows that the matter will be mentioned on 8 October 2025. I find no reason to review my earlier orders regarding the injunction to halt the auction or sale of the property in issue. But if the applicants can pay and settle what they committed to, the status quo prior to the intended sale or auction can be maintained pending the mention of the matter on 8 October 2025. It is so ordered.'
