SEAHORSE ENERGY LIMITED AND JOHN BOSCOW WANGA AND 1 Others VS COMMISSIONER GENERAL, KENYA REVENUE AUTHORITY AND STATE LAW OFFICE AND 3 Others

High Court at Mombasa High Court · · Jairus Ngaah

'I have considered the applicant''s application dated September 10, 2025, filed under a certificate of the same date. If the applicants have been summoned as part of the investigations by the respondents, on whether an offence or offences have been committed on premises that the applicants have sub-leased, I do not see how the application that effectively seeks to stop the investigations or arrest and prosecution of any person, if any offence is found to have been committed, can be comsidered urgent as to be heard during this Honourable Court''s current recess. In short, I am not satisfied that the application is urgent. I direct that the application, together with the petition, be served for mention for directions on 4 November 2025. Meanwhile, the respondents and interested party have 14 days to file and serve their response. Orders accordingly. '
