(ORIGINATING FROM CRIMINAL CASE NO. E1172 OF

2024 AT THE CHIEF MAGISTRATE’S COURT AT MOMBASA)

  1. The accused person herein has been charged with the offence of being in possession of narcotic drugs contrary to Section 3(1) as read with 3(2) (a) of the Narcotic Drugs and Psychotropic Substances Control Act. The accused pleaded guilty and was sentenced to one year imprisonment.
  2. A Sentence Review Report by John Dalluh on 9th October 2024 stated that the inmate had served 3 months of his sentence. The inmate had reflected on the dangers of drugs and vowed to involve himself in lawful economic activities and to take care of his family. He is willing to serve a non-custodial sentence and his family is responsive to receive him and assist in his rehabilitation within the community.
  3. In light of the above findings, the sentence is reviewed to the time already spent and community service for a period of three months at Miritini Chief’s Office.

IT IS SO ORDERED ACORDINGLY.
