(From the original Conviction and Sentence in the Chief Magistrates’ Court at Nyamira, Criminal Case No. MCCR E1299 of 2021 by Hon. B. Okong’o, Resident Magistrate on 20th July 2022)
The Applicant was convicted for the offence of burglary contrary to Section 304 (2) and stealing contrary to Section 279 (b) of the Penal Code. The trial court sentenced him to pay a fine of Kshs. 50,000/= and to compensate the complainant in the sum of Kshs. 240,000/= or in default to serve five (5) years’ imprisonment. The Applicant has served 1 year and 7 months of his sentence. The Sentence Review Report filed on 3rd April 2024 by Probation Officer Nelson Maroa recommends a non-custodial sentence. I hereby direct that the Applicant to serve a Community Service Order at Nyamira Law Courts under the supervision of the Court Administrator for the remaining part of his sentence.
