High Court at Makueni High Court · · Matheka, Teresia Mumbua

MATTER COMING FOR REVISION;

i have perused the LCF and the SRR. This offender is 21 years old and has been in prison twice, this is the third time. Obviously, Imprisonment is not helping, yet the Criminal Justice Agency that has the duty and obligation to assist youthful offenders to reform is simply pushing him back into the system on account of previous convictions. Surely we cannot we cannot expect to do the same thing over and over and expect change. Sometimes it is necessary to give a person a break. Let them be the ones to break their break but after giving them a chance.

There are family problems which cannot be resolved through imprisonment.

The PACS officer's recommendation at the behest of the mother  that the offender gets vocational training in prison is incredible. It is the duty of the parent to ensure that the son goes through that training but not to push for imprisonment.

In the circumstances;

On the strength of the SRR, and the POR on record:

The Offender will be placed on Probation Supervision

The PACS officer together with the family and the Local administration will organise a family meeting wjere the real problem in the family will be identified and addressed.

The mother to the offender to arrange for him to get the vocational training she believes he need through the normal TVETs

The PACs officer to ascertain whether the offender requires any counselling or other mental health issues and refer accordingly.

A report be filed with the DR within three months hereof in the presence of the offender who will attend court.

The offender to abide by the Probation Order and the conditions or risk the cancellation of the same.

Mention on 29th August before the Deputy Registrar.

Probation Order to issue Accordingly
