JUDGEMENT

By consent, the suit herein is settled in the following manner;

1. That the parcel L.R No.772/6 which is the subject matter in this suit is the property of the Estate of Rebecca Jelagat Misoi (Deceased).
2. The Grant of Letters of Administration in respect to the Estate of Rebecca Jelagat Misoi has been obtained and a Certificate of Confirmation of the Grant issued.
3. That Samuel Kiptanui Maiyo, the Plaintiff herein is entitled to a portion of 7.3acres in the property known as L.R 772/6 having purchased it from Philip Kiptoo Yego (Deceased) one of the beneficiaries of the Estate of Rebecca Jelagat Misoi.
4. That upon completion of the transmission and transfer of the portions of the property of the Estate of Rebecca Jelagat Misoi to the respective beneficiaries, the Administrator shall transfer the portion of 7.3 acres to the Plaintiff Samuel Kiptanui Maiyo.
5. The costs of conveyance and other incidentals to the transfer of the said portion of 7.3 acres shall be catered by the Plaintiff.
6. The suit be marked as settled and each party to bear its own costs.
7. The file to be closed.
