The application dated 31.10.2022 is made under section 36 of the Arbitration Act seeking to enforce an arbitral award. The application is not opposed although the Respondent was given an opportunity to oppose the application and has been served through its known and disclosed email address. The time for setting aside the award has also lapsed.
The application is therefore allowed on terms that:
(1) The Arbitration Award published on 14.09.2022 is duly recognized as a judgment of this court and leave is granted to enforce it as decree of this court.
(2) The Applicant is awarded costs of the application assessed at Kshs. 50,000.00.
