1. I have considered the Notice of Motion application dated 26th March 2026 , the supporting affidavit of the applicant and the annexures attached thereto, among which was the ruling of the Rent Restriction Tribunal delivered on 25th March 2026 by Hon Hillary Korir , the Chairman of the Tribunal .
2. From my perusal of the ruling, it is apparent that the Tribunal was of the view that it lacked jurisdiction to hear and determine the matter in view of the rent paid by the appellant. Jurisdiction is everything, and without it the court cannot take further action.
3. In the circumstances, I direct that the application be served within three working days of the date hereof for an interpartes hearing on 20th April 2026 before Visram, J .
