The issue for determination is whether this court should order a survey report by the government surveyor. I have considered the submissions by counsel. I note that pretrial was done and that this matter is now partly heard. PW1 has just testified. Parties had all the time to decide which witnesses to call and what documentary evidence to introduce. In view of the objection by Mr. Amasakha, I am not persuaded that I should make an order for a survey report by the government surveyor as is sought by Ms Munihu. I find no merit in the application, and I dismiss it.
