RULING
1. According to the Plaintiff case, the portion of 25 acres which she was to acquire was for the estate of Solomon Sorgor Lagat.
2. The only dispute is the size of the land transmitted by the Administrator to the Plaintiff.
3. Keeping in mind that the estate of Solomon Sorgor Lagat has been confimed, the Court would be settling an appeal on interference with lawful Court Orders issued on the Succession matter if the Plaintiff is successful.
4. The Court is of the view that the present file should be transferred to the High Court so that the claim by the Plaintiff can be determined in the estate of Solomon Sorgor Lagat.
5. Consequently, this file is hereby transferred to the High Court Eldoret for further action and/or determination.
6. The matter will come up pm the 3.03.2025 before the Presiding Judge High Court Eldoret for further direction.
