The Applicant has moved this court by way of an Application dated 24th March 2023 under Articles 159 and 165 of The Constitution of Kenya 2010,Section 3A of The Civil Procedure Act and Order 22 rule 32 of the Civil Procedure Code and all other enabling provisions of the Law wherein the Applicant is asking the court to revisit its earlier orders.
Upon perusing the supporting Affidavit of Anif Gulam dated 17th March 2023, it has come to my attention that the Applicant had warrants which remain unexecuted since 23rd February 2018. That is over five years ago.
The court assigned the Applicant the directions that are in keeping with the calendar of the court.
I do not find any compelling reason or justification that would persuade this court to allow the Application.
The Application is disallowed.
The matter shall be mentioned on 8th May 2023 as earlier directed by the court.
It is so ordered.
