SAHEED TUNDE OLAYIWOLA VS State Law Office AND National Police Service Commission (NPSC) AND 2 Others

High Court at Milimani High Court · · Jairus Ngaah

I have read the applicant’s  two chamber summonses both dated 21 August 2024. The first chamber summons  seeks for leave for the applicant to file a substantive motion for judicial review reliefs. The second application seeks that the  first  application  be admitted for hearing and determination during this Honorable Court’s August recess. I am not satisfied that the application is that urgent as to be heard during the recess. In any event, I gather from the application that  the applicant has been deported back to Nigeria. Nonetheless, leave is hereby granted in  terms of prayers ii(a), (b) and (c) of the chambers summons. The applicant is directed to file and serve the substantive motion within seven days of the date of this ruling. The respondents will file and serve their response to the main motion within seven days of the date of service of the applicant\'s motion. The suit shall be mentioned on 8 October 2024 for directions on the manner of its disposal. It is so ordered.
