I have read the Applicant's application dated 19th December 2025, filed under a Certificate of Urgency of even date. It is not clear from the contract document who the alleged buyer of the consignment is. More importantly, there is an arbitration clause in the agreement to the effect that, should a dispute arise between the seller and the buyer of the consignment, it shall be resolved by way of arbitration. In the circumstances, I'm not satisfied that the application is urgent. I direct the application be served for directions before Mutai, J. on 28 January 2026.
