(From the original conviction and sentence in Kisumu Chief Magistrate’s Court Criminal Case No. E108 of 2024)
1. This matter is related to Criminal Revision No. E206 of 2024. The offender Rodgers Austine Odhiambo was convicted of being found in possession of 200g of narcotic drugs to wit, cannabis sativa and he was sentenced to serve 12 months imprisonment on 15th May 2024.2. He has served 6 months. He pleaded guilty to the charge and is remorseful although he associated with bad gang of criminals. He is young man, aged 21 years old.
3. Pre-sentence review report filed recommends community service at Kudho Primary School. However, schools are in recess. He is from a supportive family.
4. In the spirit of prison decongestion, I hereby order that the offender Rodgers Austine Odhiambo shall, unless otherwise lawfully held, be conditionally released not to reoffend for 6 months.
