The Plaintiffs are the official of Kenya International Freight and Warehousing Society (KIFWA). The Societies account at the National Bank of Kenya was frozen on the basis of a letter dated 27.04.2023 by the Registrar of Societies. The Plaintiff therefore seeks orders to unfreeze the account.
The application has been served and is not opposed. I am satisfied that Bank has no reason to freeze the account of the Plaintiff based on the opinion of the Registrar of Societies. The Bank has not given any reason to freeze the account. There is also no claim on the account by any third parties.
The application dated 18.07.2023 is allowed in terms of Prayer No. 3 of the application. The Bank shall pay the costs of the application.
Mention on 28.09.2023 before the Deputy Registrar for pre-trial and other directions. Notice to issue.
