Ruling on the Respondent/Applicant's Notice of Motion Application dated 27/05/2025
Upon examination of the Respondent/Applicant's Notice of Motion Application dated 27/05/2025, I find that the same is fit and ripe for summary determination as it is merely consequential to the judgment delivered by this Court on 17/12/2024.
Consequently, the same is allowed and determined as follows:
The 6-Month period given for hearing and re-determination of Milimani SCCCOMM NO. E146 of 2022 is extended and shall apply for six months from the date of first mention post-appellate judgment before the lower court.
Mention before the Small Claims Court on 15/07/2025.
This Ruling and the Lower Court file domiciled in this Appellate File to be transmitted to the lower court by close of business 27/06/2025.
