1. The Motion, dated 4th September 2024, together with the other papers filed with it, has been placed before me, and I have read and considered it.
2. I note that the stay order sought relates to an environment and land matter, handled by the empowered magistrates court, under the relevant land legislation, in Kakamega ELC Magistrate Court MCEL/E023/2020.
3. It is, therefore, not a succession issue, and was not handled in Kakamega ELC Magistrate Court MCEL/E023/2020, as such.
4.The High Court has no jurisdiction over it, by dint of Article 162(2) of the Constitution of Kenya, 2010, and the orders sought are, therefore, not available, with respect to it, from the High Court.
5. The applicant would be better of seeking the stay order from either in Kakamega ELC Magistrate Court, in MCEL/E023/2020, or the Environment and Land Court itself.
6. These orders are made at Busia, this 6th day of September 2024.
