COURT
This matter coming up for ruling on the application dated 25/10 2024 and filed in court on 5/11/2024. I note that the matter came up for mention on 10/12/2024 before the Hon. Deputy Registrar (DR) when I was away at the High Court Human Rights conference. The Hon. DR inadvertently fixed the matter for ruling when it should have been for mention to confirm compliance with the Court's directions issued on 5/11/2024. I have noted in the CTS/E-Filing system that the Respondent filed a replying affidavit on 10/12/2024.
However, neither the Applicant nor the Respondent has filed submissions. I am not able to proceed to write the ruling before parties make submissions.
The parties are directed to concurrently file their submissions within 14 days.
I am now on transfer to Kwale High Court.
The application will now be heard by Hon. L.J. Micheni.
Mention before the Hon. DR on 13/2/2025 to confirm compliance and fix mention before the Judge for further directions.
