'Introduction
The accused person STEPHEN OUMA OMONDI alias NYAKISII alias JATIANG faces a charge of murder contrary to Section 203 as read together with Section 204 of the Penal Code.
The particulars are that STEPHEN OUMA OMONDI alias NYAKISII alias JATIANG on 1st April 2023, at Giribe village, Giribe Sub-Location, Nyatike Sub-County in Migori County within the Republic of Kenya murdered Washington Omondi Gaki.
The Accused was arraigned in court on 12th June 2025 and when information was read to him he pleaded not guilty. The Prosecuting Counsel filed an affidavit sworn on 12th June 2025 by P.C. Samson Kimeli objecting to grant of bond for reasons that after committing the offence he fled to the neighbouring country for some time and it is on return that he was arrested and brought to court. The offence herein was committed on 1st Day of April 2023 and the accused was only brought to court o 12th June 2025.
This court has considered the affidavit in support of the application to deny bond and the Replying Affidavit sworn by the accused on26th June 2025 as well as the Pre-Bail Report dated 25th June 2025 in which it is stated that the secondary victims and their witnesses live in fear of the accused herein and his co-accused who has actually absconded and find that it would not be prudent to grant bond at this point in time. In the circumstances the accused will remain in custody pending trial or upon further orders of the court in the future in event circumstances change.
